T VISAS
T visas allow certain victims of severe trafficking in persons to stay in the United States. The visa is a non-immigrant temporary immigration benefit usually up to 4 years. It allows survivors to remain in the United States, access critical services, and work legally while assisting law enforcement in the investigation or prosecution of human trafficking cases.
Who qualifies for a T Visa
To be eligible for a T Visa, applicants must meet the following criteria:
Victim of Human Trafficking
You must be a victim of a severe form of human trafficking, which includes forced labor or sex trafficking through coercion, fraud, or force.
Presence in the U.S.
You must be physically present in the United States due to trafficking.
Assistance to Law Enforcement
You must be willing to assist law enforcement in the investigation or prosecution of human trafficking (unless under the age of 18 or unable to cooperate due to trauma).
Risk of Extreme Hardship
Returning to your home country would result in extreme hardship or danger.
Benefits of a T Visa
Legal Stay in the U.S.
The T Visa grants protection for up to four years.
Work Authorization
T Visa holders are eligible for an Employment Authorization Document (EAD) to work in the U.S.
Path to Green Card
After three years in T Visa status, or upon meeting certain criteria, you may be eligible to apply for lawful permanent residency (a green card).
Family Benefits
Certain family members, including spouses, children, parents, and siblings (in some cases), may also qualify for derivative T Visas.
Access to Federal Benefits
T Visa holders may qualify for government benefits such as housing assistance, food assistance, and medical care.
